Israel trades fire with Gaza's Islamic Jihad, 10 dead (Reuters)

GAZA (Reuters) ? Israel's air force bombed an Islamic Jihad base in the Hamas-governed Gaza Strip, killing five senior militants and drawing cross-border Palestinian rocket salvoes that killed an Israeli civilian.

The flare-up on Saturday smashed a relative lull in violence that had surrounded an Egyptian-mediated prisoner swap over a week ago between Israel and Islamist Hamas, which is negotiating a power-sharing deal with U.S.-backed Palestinian rivals.

Egyptian officials said Cairo had secured a truce between the Jewish state and the Gaza militants that would take effect early on Sunday.

Saturday's strike on the Islamic Jihad training camp in southern Rafah followed a rocket attack last week which the Israelis blamed on the group. The rocket caused no casualties but landed deep enough to set off sirens on Tel Aviv's outskirts.

Islamic Jihad said one of its commanders, Ahmed al-Sheikh Khalil, and four comrades who had overseen production of bombs and rockets for the faction were killed in the mid-day strike. Two other fighters were wounded.

Israel's military said its aircraft "targeted a terrorist squad ... that was preparing to launch long-range rockets."

It said in a statement that those hit were responsible for the rocket attack late on Wednesday, though no Palestinian faction had claimed responsibility.

Islamic Jihad, a sometime Hamas ally that has recently chafed at its rule of Gaza, vowed revenge, a call echoed by smaller groups in the territory.

"There is no chance of speaking about a truce now, following such a big crime against leaders of the group," said Islamic Jihad spokesman Abu Ahmed.

By Saturday evening, at least 20 rockets and mortar bombs had hit southern Israel, killing a 50-year-old man and wounding two other civilians, police said.

Islamic Jihad and two more secular factions, the Popular Front for the Liberation of Palestine (PFLP) and al-Aqsa Martyrs Brigades, separately took credit.

Two other Israeli air strikes followed, killing four Islamic Jihad gunmen and wounding a fifth. The military said the gunmen had carried out cross-border shellings.

CONSEQUENCES

Israel demanded international intervention to stop the Palestinian attacks.

"We seek no confrontation with the Palestinians and do not want to inflame the situation, but we will not absorb shelling after shelling without a response," Foreign Minister Avigdor Lieberman said, threatening unspecified "consequences."

An Egyptian official later said all sides had agreed, at Cairo's behest, to cease fire early on Sunday.

"Egypt will pursue its contacts with all the sides until the agreement goes into effect," the official said. Neither Israel nor Palestinian factions had any immediate comment.

The United Nations, which runs an extensive aid network in Gaza and is among foreign powers trying to revive moribund peace talks between Israel and the U.S.-backed Palestinian administration in the occupied West Bank, had also urged calm.

Hamas last week repatriated an Israeli soldier it seized in 2006 in exchange for the release of more than 1,000 jailed Palestinians. That deal, brokered by Egypt's military rulers, stirred speculation a more enduring detente was in the works.

Commenting on the Rafah deaths, Hamas spokesman Sami Abu Zuhri accused Israel of a "serious escalation against our people."

In keeping with Israeli government policy, the military statement said Hamas bore ultimate responsibility "for any terrorist activity emanating from the Gaza Strip."

Islamic Jihad released images of what it said was the firing by its men of a truck-mounted multiple rocket-launcher, a platform not previously seen in Gaza. Israel says Gazan arsenals have been boosted by gun-running from Libya since the fall of its ruler, Muammar Gaddafi.

Qantas expected to resume flights after court acts

(AP) ? Qantas Airways was expected to resume flying Monday after an Australian court intervened in a labor dispute that led the airline to ground its entire fleet over the weekend.

By the time the labor-relations court acted, several hundred flights had been canceled and tens of thousands of passengers stranded around the world.

Some airline industry experts say Qantas' surprise grounding of its entire fleet Saturday could cause many travelers to book future trips on other airlines.

Qantas CEO Alan Joyce said he had no choice but to order the lockout of union workers and end months of rolling strikes that led to canceled flights, $70 million in losses and a collapse in future bookings.

Joyce told the Australian Broadcasting Corp. that he expected some flights to resume by mid-afternoon Monday. It was unclear how long it would take for the airline to resume a full schedule. The airline had estimated that it would lose $20 million a day during the lockout.

The Australian labor-relations court issued its ruling ending the standoff early Monday morning ? midday Sunday in the United States ? after holding an emergency hearing that included testimony from company, labor union and government officials.

The president of the labor-arbitration panel, Geoffrey Giudice, said the group acted to protect Australia's tourism and aviation industry.

The airline said 447 flights had been canceled in the first 24 hours of the lockout. Qantas did not immediately update that figure.

Qantas is the largest of Australia's four national domestic airlines, carrying about 70,000 passengers a day on a fleet of 108 planes that operate in 22 countries. It is the 10th largest airline in the world by passenger miles flown, according to the International Air Transport Association, an airline trade group.

Its major international destinations include Singapore, Hong Kong and London. In the United States, Qantas flies to Los Angeles, Dallas, New York and Honolulu.

Travelers reported being ordered to leave planes that were already on the tarmac when the lockout began Saturday. More than 60 planes in mid-flight flew to their destinations, then were parked.

Qantas said it paid to rebook passengers on other airlines, including compensating those who had to pay higher last-minute fares to get home.

For several weeks, workers have carried out rolling strikes and refused to work overtime to demand higher pay and protest the airline's plans to cut about 1,000 jobs. Qantas, which has about 32,500 employees, wants to reduce costs by creating new Asia-based airlines for international flying. International flights were a roughly $200 million drain on the company last year.

The company reported in August that annual profit had doubled. But it said the business climate was too turbulent ? partly because of labor turmoil ? to forecast future earnings.

Henry Harteveldt, an airline industry analyst in San Francisco, predicts the shutdown will do long-term damage to the Qantas name by hurting its reputation for reliability.

"A lot of travelers won't take a chance and will book away to Virgin Australia, Air New Zealand and other airlines," Harteveldt said. "Brand loyalty in the airline business is very low, and there is so much competition."

Before the court ruling, Virgin Australia said it was scheduling extra flights and offering 20 percent fare discounts to help stranded Qantas passengers through Thursday.

If Qantas loses customers, that could also hurt partners in its alliance of global airlines, including American Airlines. A rival alliance that includes Air New Zealand and is led by United Continental Holdings Inc. could benefit. So could a third group of airlines that includes several major Asian carriers and is led by Delta Air Lines Inc. and Air France-KLM.

Other industry veterans said the lockout was a daring move that will pay off for Qantas, which wants to expand the low-cost, low-fare model that it uses at its Jetstar Airways subsidiary.

Jetstar has extensive routes to Southeast Asia and Japan, and lower costs than Qantas. But Qantas unions fear that expansion of low-cost airlines will result in Australian jobs being sent overseas. CEO Joyce hopes to bend the unions closer to the company's vision for growth by tapping into Asian markets.

"It was a very shrewd move by their CEO to force the issue and stop the potential deterioration of the brand," said Mo Garfinkle, an airline consultant who has worked for Qantas rival Virgin Australia. "In the end, it will benefit Qantas financially."

Garfinkle said the short duration of the fleet grounding will help Qantas get back up to full speed quickly, cutting its losses.

KABUL (Reuters) - A suicide car bomber on Saturday killed 13 troops and civilian employees of the NATO-led force in Kabul, including Americans and a Canadian, in the deadliest single ground attack against the coalition in 10 years of war in Afghanistan.

"Five International Security Assistance Force (ISAF) service members and eight ISAF civilian employees died following a suicide vehicle-born improvised explosive device attack in Kabul earlier today," ISAF said in a statement.

Gays In The Military Bring Lawsuit To Overturn DOMA

WASHINGTON -- Just over a month after the repeal of Don't Ask, Don't Tell, the Servicemembers Legal Defense Network on Thursday announced a lawsuit seeking to strike down the federal Defense of Marriage Act.

The lawsuit, first reported by The Huffington Post last week, will be filed in Massachusetts federal court on Thursday on behalf of eight current and retired service members and their families. According to SLDN, the plaintiffs are challenging the constitutionality of DOMA as well as provisions in Titles 10, 32 and 38 of the U.S. Code that prevent service members in same-sex marriages from receiving the same benefits as heterosexual couples.

At an event announcing the lawsuit at the National Press Club, the plaintiffs and their family members cast the challenge in terms of fairness. "The case we are bringing is about one thing, plain and simple: It's about justice for gay and lesbian service members and their families and our armed forces," said Aubrey Sarvis, an Army veteran and the executive director of SLDN. He stressed that all eight plaintiffs were "legally married" in various states.

Shannon McLaughlin, a major in the Massachusetts National Guard and one of the plaintiffs, made a similar argument. Standing at the podium with her wife and 10-month-old son, she declared that the issue boils down to this: "We've been serving our country too long, working too hard, sacrificing too much to see our families denied the same recognition, support and benefits as our straight married counterparts."

Those benefits include medical coverage, access to military bases, allowances for housing and unit programs that provide support and information to family members. Their denial has taken a concrete toll on service members in same-sex marriages.

Army Lt. Col. Victoria Hudson, for example, highlighted the burden on her and her wife when Hudson was deployed to Iraq in 2005. By her own count, she commanded convoys 19 times while overseas, and each time "it makes you think about, if I don't come back, who's going to notify my wife?" She told The Huffington Post that such clear injustice gives her confidence that the public will understand and support repealing DOMA: "When I say that, you know, I go to Iraq and if I had died my wife, Monica, wouldn't have been notified, they're appalled."

With the Obama administration no longer defending DOMA against legal challenges, SLDN hopes that the case will proceed quickly. Christopher Mann of the law firm Chadbourne & Parke, which is handling the case, said that between the administration's stance and the court's previous experience with DOMA issues, he hoped for a resolution within "a few months."

The U.S. District Court for the District of Massachusetts has ruled against DOMA in the past, and Mann cited its familiarity with the issue as the reason why SLDN initiated the lawsuit there. "That court's already briefed the issues, they're familiar with it, so it makes sense to go ahead and file there rather than reinvent the wheel before another court," he said. In response to a question, he said the issue may not need to proceed as far as the Supreme Court.

In 2004, Massachusetts became the first state to recognize marriage equality. Since doing so, the it has seen more than $100 million in economic benefits from spending on those weddings. According to the U.S. Census Bureau, Massachusetts also enjoys the lowest divorce rate in the nation, with 2.2 divorces for every 1,000 couples.

The SLDN lawsuit is not the only current challenge to DOMA. Carmen Cardona, a lesbian Navy veteran, recently filed suit in Connecticut to claim disability benefits for her and her spouse. The payments are currently denied because her marriage, while legal in the state, is not recognized by the Department of Veterans Affairs. But any ruling in Cardona's suit, which will be heard by the U.S. Court of Appeals for Veterans Claims, would not apply to gays who are currently serving in the military.

In Congress, the Senate Judiciary Committee will begin debate over DOMA repeal on Nov. 3. The proposed Respect for Marriage Act, introduced by Sen. Dianne Feinstein (D-Calif.) and co-sponsored by 30 others, seeks to overturn federal restrictions on recognizing same-sex marriages. While the bill, supported by the committee's entire Democratic majority, is almost certain to advance to the Senate floor, it stands little chance of passing the Republican-controlled House.

Still, SLDN is hopeful that the legislation is a positive sign. "It's unclear which train will get to the station first, but they will be moving on parallel tracks," said Zeke Stokes, the group's communications director.

Guy Firebombs Taco Bell Over Alleged Chalupa Meat Skimping


An irate Taco Bell customer did not take kindly to the fast food giant skimping on the meat in his chalupa on Sunday. His recourse? Firebombing the joint.

Georgia police are hunting for the aggrieved patron after he threw a Molotov cocktail at the restaurant’s drive-thru window after phoning in a complaint.

Guess the phone response he received was insufficient.

The bizarre incident occurred in Albany, Ga. Fortunately, the small blaze did not cause injuries or damage to the building, but it terrified the staff.

Manager Cynthia Thompson told cops that, shortly before the firebombing, a man called the restaurant to whine about the reported meat shortage.

The caller said that “after getting home realized that there was not enough stuffing inside of his chalupas, and demanded his order be corrected.”

When Thompson “could not accommodate him because the business was closing,” the man replied, “You must be one of them n---ers up there.”

He added, “That’s alright, I’ll just come and redecorate the place.”

This story? Not exactly uplifting for one's faith in humanity.

If there was any doubt that Dolphins coach Tony Sparano is bracing ? and/or hoping ? to be fired, there should now officially be none.

According to Jorge Sedano of 790 The Ticket in Miami, Sparano has put his house up for sale.

It may not be a coincidence that the news comes a day after word broke of the Dolphins? flirtation with former Steelers coach Bill Cowher.? In January, Sparano endured the indignity of owner Stephen Ross and G.M. Jeff Ireland pursuing former Stanford coach Jim Harbaugh for the job that Sparano still held.

The latest development possibly reflects something more than Sparano getting ready for the inevitable.? He?s smart enough to at least wonder whether owner Stephen Ross is maintaining the status quo, at least for now, in order to increase the chances of sliding to the bottom of the league, and in turn to the top of the draft order.? If Sparano is fired, he?d get a buyout for the balance of his contract, which was extended as a courtesy/apology/P.R. move after the Harbaugh debacle ? and Sparano would get a head start on finding his next job, presumably as an offensive line coach.? He could even join a team for the balance of the 2011 season, as a consultant.

Thus, it?d be interesting to know how many times Sparano has overruled assistant coaches this year, deliberately making ill-advised calls that contributed to losses.? I have no reason to think this has happened, but if I were investigating whether he?s trying to get fired, that would be an obvious place to start looking for proof.

Regardless, it?s now clear Sparano knows it?s coming.? The only remaining questions are whether he?s trying to make it happen and, if so, when it will indeed occur.

UPDATE 5:45 p.m. ET:? Sparano said today that he put the house up for sale because he?s an ?empty-nester.?? Ben Volin of the Palm Beach Post reports that the house was ?initially? put on the market in January, a week after Sparano received a contract extension from the team ? and also roughly two weeks after he was figuratively castrated by an owner who tried to hire Jim Harbaugh.

Olympus shares surge after chief quits (Reuters)

TOKYO (Reuters) ? Olympus Corp's shares surged in brisk trade on Thursday after its chairman and president quit and his successor said he would explain past M&A deals at the heart of a scandal that wiped out half of the firm's market value.

Olympus's former chief Tsuyoshi Kikukawa resigned from the top posts on Wednesday saying he wanted to restore confidence in the 92-year-old company, shaken by a public stand-off with its ex-CEO over a hefty advisory fee and other past deals.

The new President Shuichi Takayama denied any wrongdoing by the firm, and the appointment of the 41-year veteran which was announced after the market close was initially greeted with skepticism by investors.

The company fired its British President and Chief Executive Michael Woodford on October 14, just two weeks after his appointment as CEO, saying he failed to understand the company's management style and Japanese culture. Kikukawa then took over Woodford's role.

Woodford in turn said he was sacked for questioning a $687 million advisory fee paid in relation to a $2.2 billion takeover in 2008, as well as other deals, and for urging Kikukawa to step down.

Olympus shares, which have lost about half of their value since Woodford's sacking, were up 13 percent at 1,242 yen on Thursday and were the most heavily traded stock by turnover, reflecting expectations that the company will shed more light on deals at the heart of the controversy.

Pressure has been mounting on the camera and endoscope maker to disclose more information on its takeover of medical equipment maker Gyrus in 2008 and on other deals.

"So far the company is just repeating that nothing was inappropriate in its M&A deals," said an analyst who said he could not be named because he had suspended coverage on Olympus. "We need more information on these advisory fees: Who was paid how much and why."

Japan's Securities and Exchange Surveillance Commission has been looking into the company since August, sources familiar with the matter told Reuters.

A senior ruling party lawmaker has also called for probes by Japan's financial and securities watchdogs and urged Olympus to explain the fees, which could undermine shareholder confidence in Japanese corporate governance.

The Olympus scandal could re-ignite debate over what critics say is a deep-seated weakness of Japanese management -- a lack of strong independent oversight of boards, which gives shareholders' rights short shrift.

Takayama, 61, joined Olympus straight from an engineering high school in 1970 and has served on the company's board since 2006 after holding several senior managerial positions.

Ex-CEO Woodford has said he was now talking to the U.S. Federal Bureau of Investigation and Britain's Serious Fraud Office.

Woodford has identified the advisory firms involved in the Gyrus takeover as New York-based AXES America LLC and AXAM Investment Ltd in the Cayman Islands.

Indonesia cuts jail sentence for militant cleric (Reuters)

JAKARTA (Reuters) ? Indonesian Islamist cleric Abu Bakar Bashir, convicted of aiding a paramilitary group out to assassinate the president, has had his jail sentence cut from 15 years to nine, a court said on Wednesday, a decision which dismayed some security analysts.

The sentence was cut last Thursday.

"Very disappointing," Jakarta-based analyst Noor Huda Ismail told Reuters. "How can someone that condones violence be given a sentence reduction?"

Indonesia, the world's most populous Muslim-majority country, has been the scene of some major attacks by militants and radical groups over the past decade, but there have been few attacks recently.

Bashir is considered the spiritual leader behind the group that killed more than 200 people in Bali in 2002.

He was found guilty of helping plan and fund a paramilitary training camp discovered last year in a remote mountainous part of Aceh, whose members sought to assassinate the president, destabilize Southeast Asia's largest economy and turn the officially pluralist country into an Islamic state.

Bashir, who was acquitted on a charge of possessing weapons, had denied involvement in the plan. He was jailed in June.

Surveillance video leads to 2 in school shooting (AP)

FAYETTEVILLE, N.C. ? An 18-year-old high school student in North Carolina is charged with felony aiding and abetting after a 15-year-old girl was shot and wounded at the school.

Ta'Von McLaurin is scheduled to appear in court Tuesday. A 15-year-old suspect will go to juvenile court for the shooting, though it was unclear what the charges would be or when he would appear.

Catilyn Abercrombie was taken to a local hospital after being shot in the neck at Cape Fear High School on Monday afternoon. She was listed in stable condition after surgery.

Authorities in Cumberland County say surveillance video showed two suspects carrying a rifle inside the school.

A normal class schedule was planned Tuesday, with extra deputies on hand.

s How Steve Jobs Created Modern Magazines - Business Insider

Steve Jobs gets credit for revolutionizing the magazine industry with the iPad.

But even well before that, he was changing the print landscape.

How?

Well, Macintosh's "What You See Is What You Get" interface helped, as did the LaserWriter printer, email attachments (part of NeXT), Adobe InDesign and Adobe InCopy, and plenty of other Apple-related products, Scott P. Richert writes on The Chronicles blog (with a huge h/t to John Carney who pointed this out on his Tumblr).

It's pretty cool when you think about it all.

Here's the whole story if you're interested in more:

Before Steve Jobs introduced the Macintosh on January 24, 1984, Chronicles was put together the way most magazines were.? Authors sent their typewritten manuscripts (with corrections often handwritten in pencil or ink) by mail to our editorial office.? The manuscripts had to be retyped (incorporating the authors? corrections) before they were edited, and after every round of editing.? To lay out the magazine, the text had to be typeset into galley form, and then cut and pasted (with scissors and glue) onto the page, and waxed to hold everything in place (and hide the cut edges).? The pages were sent to a prepress house, which tidied them up, inserted images and ads, and took pictures of the composed page (one piece of film for each color on the page).? ?Bluelines? (essentially mimeographed proofs) were created from those negatives and returned to our offices.? Any necessary corrections to the bluelines entailed recomposing the entire page, shooting new film, and running new bluelines.? When the bluelines were finally approved, the negatives were shipped to our printer, where they were transferred to printing plates.? Any problems discovered by the printer on any of the plates required returning to square one on that plate.? (And each plate contained either four or eight pages of the magazine, so a problem on one page affected several others as well.)? The printer would provide the first hard copies in about ten business days after delivery of the final, problem-free negatives.

All of that began to change in 1984.? The Macintosh?s graphical user interface allowed programmers to create a ?WYSIWYG? environment??What You See Is What You Get.?? That, along with Apple?s LaserWriter printer (which accurately reproduced what you saw on screen), set the stage in 1985 for desktop publishing.

Today, authors send us their text as e-mail attachments (an innovative feature of Jobs? NeXTSTEP operating system), mostly written in Microsoft Word (which made its first appearance as a WYSIWYG word processor when it was ported to the Macintosh in 1985).? Many of our writers now own a Mac, but some still use a PC running Windows, which got its start as an imitation of the Macintosh operating system, bolted on top of MS-DOS.

Aaron Wolf imports the text directly into Adobe InDesign and exports it for editing onscreen in Adobe InCopy.? Adobe?s first big break came in 1985, when Apple licensed Adobe?s PostScript language for use in the LaserWriter.? Aaron and I edit each article twice onscreen (30-inch Apple Cinema Displays connected to Mac Pros), before Aaron sends the galleys (as PDFs, via e-mail) to each author.? Aaron enters any corrections received from the author, Dr. Fleming, and proofreaders? into InDesign.? Along the way, he inserts images and ads directly into the layout.? George McCartney, Jr., who provides many of our covers, creates them on a Mac and sends them through e-mail and the web.

After a final reading of page proofs and the entering of any last-minute corrections, we export each page as a separate PDF (perhaps ten minutes? work total, the time it took to wax a couple of pages) and upload them through the internet to our printer in Michigan.? The printer immediately provides a digital proof of the entire issue, and we approve it onscreen.? It goes into production the very next morning, and the printer provides hard copies after four business days.? The production process for a single issue has gone from almost three months to less than a month.? APNewsBreak: US drops keeping troops in Iraq (AP)

BAGHDAD ? The U.S. is abandoning plans to keep U.S. troops in Iraq past a year-end withdrawal deadline, The Associated Press has learned. The decision to pull out fully by January will effectively end more than eight years of U.S. involvement in the Iraq war, despite ongoing concerns about its security forces and the potential for instability.

The decision ends months of hand-wringing by U.S. officials over whether to stick to a Dec. 31 withdrawal deadline that was set in 2008 or negotiate a new security agreement to ensure that gains made and more than 4,400 American military lives lost since March 2003 do not go to waste.

In recent months, Washington has been discussing with Iraqi leaders the possibility of several thousand American troops remaining to continue training Iraqi security forces. A Pentagon spokesman said Saturday that no final decision has been reached about the U.S. training relationship with the Iraqi government.

But a senior Obama administration official in Washington confirmed Saturday that all American troops will leave Iraq except for about 160 active-duty soldiers attached to the U.S. Embassy.

A senior U.S. military official confirmed the departure and said the withdrawal could allow future but limited U.S. military training missions in Iraq if requested.

Both officials spoke on condition of anonymity because of the sensitivity of the issue.

Throughout the discussions, Iraqi leaders have adamantly refused to give U.S. troops immunity from prosecution in Iraqi courts, and the Americans have refused to stay without it. Iraq's leadership has been split on whether it wanted American forces to stay. Some argued the further training and U.S. help was vital, particularly to protect Iraq's airspace and gather security intelligence. But others have deeply opposed any American troop presence, including Shiite militiamen who have threatened attacks on any American forces who remain.

Prime Minister Nouri al-Maliki has told U.S. military officials that he does not have the votes in parliament to provide immunity to the American trainers, the U.S. military official said.

A western diplomatic official in Iraq said al-Maliki told international diplomats he will not bring the immunity issue to parliament because lawmakers will not approve it.

A White House spokesman, Tommy Vietor, said discussions with Iraq about the security relationship between the two countries next year were ongoing.

Pentagon press secretary George Little said the U.S. remains "committed to keeping our agreement with the Iraqi government to remove all of our troops by the end of this year."

"At the same time we're building a comprehensive partnership with Iraq under the Strategic Framework Agreement including a robust security relationship, and discussions with the Iraqis about the nature of that relationship are ongoing," Little said.

The Strategic Framework Agreement allows for other forms of military cooperation besides U.S. troops on the ground. Signed at the same time as the security accord mandating the departure deadlines, it provides outlines for the U.S.-Iraqi relationship in such areas as economic, cultural and security cooperation.

Iraqi lawmakers excel at last-minute agreements. But with little wiggle room on the immunity issue and the U.S. military needing to move equipment out as soon as possible, a last-minute change between now and December 31 seems almost out of the question.

Regardless of whether U.S. troops are here or not, there will be a massive American diplomatic presence.

The U.S. Embassy in Baghdad is the largest in the world, and the State Department will have offices in Basra, Irbil and Kirkuk as well as other locations around the country where contractors will train Iraqi forces on U.S. military equipment they're purchasing.

About 5,000 security contractors and personnel will be tasked with helping protect American diplomats and facilities around the country, the State Department has said.

The U.S. Embassy will still have a handful of U.S. Marines for protection and 157 U.S. military personnel in charge of facilitating weapons sales to Iraq. Those are standard functions at most American embassies around the world and would be considered part of the regular embassy staff.

When the 2008 agreement requiring all U.S. forces leave Iraq was passed, many U.S. officials assumed it would inevitably be renegotiated so that American forces could stay longer.

The U.S. said repeatedly this year it would entertain an offer from the Iraqis to have a small force stay behind, and the Iraqis said they would like American military help. But as the year wore on and the number of American troops that Washington was suggesting could stay behind dropped, it became increasingly clear that a U.S. troop presence was not a sure thing.

The issue of legal protection for the Americans was the deal-breaker.

Iraqis are still angry over incidents such as the Abu Ghraib prison scandal or Haditha, when U.S. troops killed Iraqi civilians in Anbar province, and want American troops subject to Iraqi law.

American commanders don't want to risk having their forces end up in an Iraqi courtroom if they're forced to defend themselves in a still-hostile environment.

It is highly unlikely that Iraqi lawmakers would have the time to approve a U.S. troop deal even if they wanted to. The parliament is in recess on its Hajj break until Nov. 20, leaving just a few weeks for legislative action before the end of year deadline.

Going down to zero by the end of this year would allow both al-Maliki and President Barack Obama to claim victory. Obama will have fulfilled a key campaign promise to end the war and al-Maliki will have ended the American presence in Iraq and restored Iraqi sovereignty.

The Iraqi prime minister was also under intense pressure from his anti-American allies, the Sadrists, to reject any American military presence.

An advisor close to al-Maliki said the Americans suggested during negotiations that if no deal is reached in time, U.S. troops could be stationed in Kuwait.

With the U.S. military presence in Iraq currently at about 41,000 and heading down to zero, almost all of those forces will be flowing out of Iraq into Kuwait and then home or other locations.

A western expert in Iraq said it is conceivable that if the Iraqi government asks early next year for U.S. troops to return, there will be forces still in Kuwait able to come back and do the job.

But he stressed that the core problems still remain on the Iraqi side about what types of legal immunity to give the American troops and whether parliament can pass it.

Airline attack suspect relying on lawyer in court (AP)

DETROIT ? An attorney defending a man accused in a failed plot to bring down a U.S.-bound jetliner faces a tough task pecking away at the government's evidence in a case where the suspect was captured in a snap.

Umar Farouk Abdulmutallab, charged with trying to turn an underwear bomb into a weapon of mass destruction, is acting as his own lawyer. But in practice, the young Nigerian is relying on Anthony Chambers to handle the minute-by-minute work in the courtroom.

Chambers will grill most of the government's witnesses and recently persuaded Abdulmutallab to let him give the opening statement Tuesday in federal court. The result is likely to be a more focused defense and not a wild justification for trying to bring down an Amsterdam-to-Detroit flight on behalf of al-Qaida on Christmas 2009.

Abdulmutallab has written a few court filings in his own hand, including a request to be judged by Islamic law. He has at times appeared agitated in court, declaring that Osama bin Laden and a radical Muslim cleric recently killed by the U.S. are alive. He also has objected to trial testimony from experts who will talk about al-Qaida and martyrdom.

Chambers will be "more traditional in holding the government's feet to the fire and making them prove the case," said Lloyd Meyer, a Chicago lawyer and former federal prosecutor.

Chambers told The Associated Press that he and Abdulmutallab will "challenge everything" offered by federal prosecutors, including the chemical mix that caused smoke and fire but didn't explode inside the cabin of Northwest Airlines Flight 253. He didn't elaborate and acknowledged Abdulmutallab's role outside the courtroom has made things tougher.

"He's driving the bus. He's making the ultimate decisions on everything," Chambers said. "His self-representation certainly makes it more difficult strategically. But we're doing the best we can with what we have to work with."

The evidence is stacked high. Abdulmutallab, 24, was badly burned in a plane full of witnesses. The government says he told FBI agents he was working for al Qaida and directed by Anwar al-Alwaki, a radical, American-born Muslim cleric recently killed by the U.S. in Yemen. There are photos of his scorched shorts as well as video of Abdulmutallab explaining his suicide mission before departing for the U.S.

While being screened last week in court, some members of the jury pool were puzzled over Abdulmutallab's wish to be his own lawyer.

"You've seen enough shows and read enough novels. It's like having a doctor being his own physician. It's not your best advantage," a tool-and-die worker told a judge while Abdulmutallab listened.

Chambers, 50, came to the case a year ago after Abdulmutallab fired a four-member team from the Detroit Federal Defender Office and said he would represent himself. It's common for a federal judge to appoint a lawyer as "standby counsel" to assist someone who chooses to go alone.

But U.S. District Judge Nancy Edmunds has allowed Chambers, an attorney for 26 years, to do more than stand by. He filed detailed challenges to the government's use of Abdulmutallab's incriminating statements made from a hospital bed and without Miranda warnings. He thoroughly cross-examined a pharmacologist who testified during a pretrial hearing about the effects of a painkiller given to Abdulmutallab for his burns before the FBI interview.

Chambers and his staff also have done research that Abdulmutallab could not have accomplished behind bars awaiting trial.

"The goal of the court is to get the best representation so no one down the road can claim (Abdulmutallab) was railroaded or forced to assume a responsibility he could not handle," explained David Steingold, a longtime Detroit defense attorney.

At 6 feet 4 inches tall and with a smooth, deep voice, Chambers has a "commanding presence," Steingold said. "But what makes him an excellent lawyer is his attention to detail and his demeanor in court. You rarely see him rattled. If he does get upset it is righteous and the jury recognizes that. ... If there's a hole in the government's case, Tony will find that hole and rip into it."

Earlier this year, Chambers was in the Virgin Islands for a high-profile hospital corruption trial, which ended without a unanimous verdict. Among his Detroit federal cases, he defended a man in 2004 who was charged with killing a former police officer over drugs. Thelmon Stuckey III insisted on testifying and was convicted. A judge called it "self-destruction."

"No one could hold Tony responsible for that result," Steingold said.

Kercher family remembers daughter

Meredith Kercher would have been 25. The British student would have finished her degree at Leeds University and perhaps been preparing for another Halloween, a day she loved.

Instead, her family awaits an appeals verdict expected Monday against former roommate Amanda Knox, of Seattle, who was convicted along with her Italian ex-boyfriend of murdering Kercher in 2007.

Kercher's killing has spawned one of Italy's most sensational and closely watched trials. Yet to her family's frustration, Kercher has been eclipsed in the public's eye by the 24-year-old Knox, as supporters of the photogenic American mount a high-profile campaign to free her.

By contrast, Kercher's family has chosen to remain largely silent during the years of trial and appeal, quietly honoring her memory on the Nov. 1 anniversary of her death and her birthday on Dec. 28. But they are growing increasingly agitated as the appeal verdict approaches.

In one of the few TV interviews they have granted, Kercher's sister Stephanie and mother Arline said attention should focus on justice for the victim, not Knox or her ex-boyfriend Raffaele Sollecito, who is also appealing his conviction alongside Knox.

"In this whole case ? going on four years ? Meredith has been forgotten," Stephanie Kercher said in a recorded interview on RAI public television this month.

"The attention has completely moved from Meredith to Amanda and Raffaele," she said. "She was lovely, kind and we lost her."

'A girl full of life'
On her last Halloween, one day before her death, Meredith dressed as a vampire. Photographs, some of the last of her life, show her smiling brightly with red lipstick, a high-collared cape wrapped around her neck.

The young student fought hard for approval from her university to study in the charming medieval town of Perugia, arriving in September 2007. She was excited to have found a room with a view of the Umbrian landscape, court records show. She shared the apartment with two young Italian women and Knox, who moved in around the same time.

Kercher made friends fast, testimony in the first trial shows. Within weeks, she had a small group of British girlfriends with whom she went dancing or watched films, and she had started dating a young Italian living downstairs. Giacomo Silenzi has said they fell in love quickly, and has been left to wonder what the future might have held had she not been killed.

On the last night of her life, she ate pizza and apple crumble with a small group of friends, watched a movie and went home alone around 9 p.m., according to court testimony.

Meredith was 21 when she was found the afternoon of Nov. 2 sprawled naked on the floor of her locked bedroom, throat slashed, body covered in a blanket.

Prosecutors claim that she was murdered when a drug-fueled sexual encounter with the two defendants and a third man went awry. Rudy Guede, an Ivorian who lived in Perugia from age 5, is serving a 16-year sentence for his role in the murder.

Knox was sentenced to 26 years, Sollecito to 25. All three proclaim innocence.

Meredith's father John Kercher, a freelance journalist, has said he refused to view her body, so he could remember as she was in life.

"I had last seen her a couple of weeks before, when she flew home to buy winter clothes. We met for a coffee and she showed me some boots she had bought," John Kercher wrote in the Britain's Daily Mirror tabloid. "I want that to be the one memory of my daughter I hold in my mind forever."

She was the baby of the family, with three older siblings ? two brothers and a sister.

She loved ballet and gymnastics, and had an orange belt in karate. She wrote poetry and stories. People remembered her as being warm and generous, full of hugs, lending class notes to anyone who asked, and always rushing to help anyone who needed it.

After arriving in Perugia, she kept a cell phone with a British number to stay in close contact with her mother, who was in poor health.

Only one vice is ever mentioned. "She was always late, always running," her mother Arline said on the RAI TV interview. "She was a girl full of life. She loved music, she loved to dance. She was full of joy in her heart."

The degree the quietly studious Kercher would have been awarded in 2009 was granted posthumously. It was accepted by her sister Stephanie to a standing ovation at Leeds.

Awaiting a verdict
During rebuttals on Friday, the Kerchers' lawyer, Francesco Maresca, urged the jury to "confirm the truth" in front of the victim's mother, sister and a brother, who would make the journey to Italy for the verdict.

"You will look Meredith's family in the eyes only once," Maresca said. "They could not always be here in court due to the mother's health problems and siblings' economic problems."

In fact, he said, they had trouble finding airline tickets for the verdict, which the lawyer contrasted with reports that the Knox family had a private jet ready to whisk the American student out of the country in the case of a not guilty finding. Knox's family has denied the existence of such a plan.

Earlier, prosecutor Giuliano Mignini said acquitting Knox would mean forever losing a chance at justice.

"We know what an acquittal means ? a swift escape abroad," he told the appeals court. "Escape we could no longer remedy."

The prosecution detailed DNA evidence and other circumstantial clues as they had their last chance to talk to the jury.

While they cling to their memories, the Kercher family says it will continue to fight for justice ? even as it delays their own process of healing.

The Kerchers have no doubts about whether Knox is guilty ? and express rage that she's garnering most of the attention.

"As a journalist myself, I know the reason why. Knox is young, attractive and female. To many, she seems an unlikely killer," John Kercher wrote in The Daily Mail tabloid in December as the appeals trial got under way. "Yet to my family she is, unequivocally, culpable."
